Federal and State Statutes

Federal and State statutes provide certain protections for the school district, the custodian, all employees, and the students in a public school district.

Federal Law. Certain public school employees, including school custodians, are covered under the Fair Labor Standards Act, which provides protection against employee abuses, including discrimination and overtime abuse. (See Federal Bulletin #778 — Overtime Compensation1, which defines how the employer should properly calculate overtime.)

State Law. State Public School Education Law covering such matters as boiler licensing standards, equipment safety, hazardous material handling, and building security is particularly important for school custodians. These laws can be found in the body of education law, enacted by your State.
