Cosponsor the FAIR Leave Act (S. 3321/H.R. 3404)
The bipartisan FAIR Leave Act (S. 3321/H.R. 3404) would eliminate the longstanding and deeply unfair FMLA marriage penalty that allows employers to limit time off taken by married couples to care for a new child, ailing parent, or injured military family member.
Current law allows individuals up to 12 weeks of leave. But when married couples work at the same place, their employer can require them to split the 12 weeks between the two of them.
This marriage penalty reduces the total amount of leave for such couples and shortchanges their loved ones on caregiving time.
