Dear Representative:
On behalf of our 3 million members and the 50 million students they serve, we urge you to VOTE NO on the Title IX Clarification Act of 2026 (H.R. 8781) and the Heat Standards Act of 2025 (H.R. 6213) at the markup scheduled for tomorrow. Votes on these issues may be included in NEA’s report card for the 119th Congress.
H.R. 8781 would amend federal law to specify that Title IX’s prohibition on sex discrimination is based on biological sex, not gender identity, in athletics, sex-separated facilities, and other education programs. The change would substantially narrow protections for transgender students and undermine the overall purpose of Title IX: preventing discrimination in education. Specific consequences could include:
- Limiting transgender students’ participation in sports teams and access to restrooms or locker rooms consistent with their gender identity
- Increasing discrimination against—and stigmatization of—transgender and non-binary students
- Legal conflicts with certain court decisions and state laws
Every student—regardless of gender, race, or zip code—deserves an equal opportunity to succeed, including transgender youth. Like all students, they deserve the opportunity to participate fully in sports and other school activities that help prepare them to succeed in school and in life. Such activities teach young people leadership, confidence, self-discipline, and teamwork—lessons no child should be denied because of who they are.
H.R. 6213 would prohibit the Secretary of Labor from finalizing, implementing, or enforcing a proposed standard to help prevent heat-related injuries and deaths. NEA strongly supports the standard for the reasons detailed in comments formally submitted via www.regulations.gov. Those comments are available at www.regulations.gov/comment/OSHA-2021-0009-25378.
Please VOTE NO on the Title IX Clarification Act of 2026 (H.R. 8781) and the Heat Standards Act of 2025 (H.R. 6213).
